These Terms & Conditions ("Terms") govern your use of PixelAPI, operated by Creativehorns LLP, a limited liability partnership registered in India ("Company", "we", "us", "Creativehorns"). By accessing or using PixelAPI, you agree to be bound by these Terms.
1. Service Description
PixelAPI provides AI-powered image and video processing via REST API, including background removal, image generation, virtual try-on, upscaling, and related services. Access is provided via API keys purchased on pixelapi.dev.
2. Account Registration
- You must provide accurate information during registration.
- You are responsible for maintaining the confidentiality of your API keys.
- You must be at least 18 years of age to use PixelAPI.
- One account per individual or organization. Sharing accounts is prohibited.
3. Acceptable Use
You agree NOT to use PixelAPI to:
- Generate illegal, harmful, abusive, sexually explicit, obscene, pornographic, paedophilic, or non-consensual intimate content
- Generate, modify, or transmit any synthetically generated information (including deepfakes, voice clones, morphed images, or face/body swaps) that depicts an identifiable person without that person's verifiable consent
- Generate any synthetically generated information that impersonates another person, falsely portrays a real individual or event, or creates a false document or false electronic record
- Generate, modify, or distribute child sexual exploitative or abuse material (CSAM)
- Generate content harmful to a child, invasive of another person's bodily privacy, or that exposes a person's private area or shows them in full or partial nudity, sexual act, or conduct, without that person's consent
- Generate content that threatens the unity, integrity, defence, security, or sovereignty of India, friendly relations with foreign States, or public order
- Violate any applicable laws or third-party rights
- Attempt to reverse-engineer, decompile, or extract model weights
- Resell API access without written permission from Creativehorns LLP
- Upload images of individuals without their consent
- Modify, suppress, remove, or obscure the "AI-generated" label, watermark, or provenance metadata that PixelAPI embeds in every synthetically generated output
- Conduct load testing or stress testing without prior approval
3A. Statutory Warning — Synthetic / AI-Generated Content (IT Rules 2021, Rule 3(1)(ca) & Rule 3(3))
PixelAPI is a computer resource that may enable the creation, modification, or alteration of synthetically generated information within the meaning of Rule 2(1)(wa) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (as amended on 10 February 2026 by G.S.R. 120(E)). You are hereby warned that misuse of PixelAPI to generate, modify, publish, transmit, share, or disseminate any unlawful content — including but not limited to deepfakes, non-consensual intimate imagery, artificially morphed images of any person, content that impersonates another person, or any false document or false electronic record — may constitute an offence under one or more of the following laws:
- Information Technology Act, 2000
- Bharatiya Nyaya Sanhita, 2023 (Act 45 of 2023)
- Protection of Children from Sexual Offences Act, 2012 (Act 32 of 2012)
- Representation of the People Act, 1951
- Indecent Representation of Women (Prohibition) Act, 1986
- Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013
- Immoral Traffic (Prevention) Act, 1956
- Explosive Substances Act, 1908
- Any other law for the time being in force
Upon becoming aware of a violation of this clause or of Rule 3(3) of the said Rules, Creativehorns LLP shall, at its sole discretion and without prior notice, take one or more of the following actions:
- Immediate takedown of the offending content from its computer resource — within two (2) hours where the content is in the nature of any material covered by Rule 3(2)(b) (private area exposure, full or partial nudity, sexual act, impersonation in electronic form, or artificially morphed images) on receipt of a complaint, and as expeditiously as possible in all other cases;
- Suspension or termination of your account and of your access to PixelAPI, including forfeiture of any unused credits;
- Disclosure of your identity, account details, and content metadata to the affected individual or to law-enforcement authorities, as required by law or by lawful direction of any court or competent authority;
- Statutory reporting to the appropriate authority where the underlying offence is mandatorily reportable (including under POCSO 2012 for any CSAM event).
PixelAPI deploys automated technical measures (input-image safety checks, prompt classifiers, output moderation) to prevent the creation of content prohibited by Rule 3(3)(a)(i). All outputs of PixelAPI are automatically labelled as "AI-generated" in the visual frame and carry a permanent embedded provenance identifier (per-job UUID + XMP/EXIF metadata) in compliance with Rule 3(3)(a)(ii). Modifying, suppressing, removing, or obscuring this label or metadata is a separate violation of Rule 3(3)(b) and of these Terms.
To report content that violates this clause, write to the Grievance Officer (see our Grievance Redressal page) or email [email protected]. Complaints relating to Rule 3(2)(b) content (non-consensual intimate imagery, morphed images, impersonation) will be acted on within two (2) hours of receipt.
4. Credits and Billing
- Credits are purchased in advance and are non-transferable between accounts.
- Credit Validity & Expiry: All credits — whether purchased (paid plans and top-up packs) or complimentary (free trial credits) — are valid for 30 (thirty) calendar days strictly from the date they are credited to your account. Credits expire automatically at the end of this 30-day window if no qualifying recharge or renewal occurs within the validity period (see Carry-Forward clause below). Upon expiry, the unused balance is forfeited, your account is downgraded to the Free plan, and your credit balance is reset to zero. Specific accounts may receive a documented validity-period exception in writing from Creativehorns LLP.
- Carry-Forward on Timely Recharge / Renewal: If you make a qualifying recharge (top-up pack), subscription renewal, or new subscription purchase before your existing credits expire, your unused balance is carried forward and gains a fresh 30-day validity window measured from the date of the new transaction. Old and new credits combine into a single balance under the new expiry date. Recharges or renewals made after the expiry date do not retroactively restore forfeited credits — only future credits granted on that transaction are valid for 30 days going forward.
- Advance Notice: We send a courtesy email reminder to your registered email address when your credits are scheduled to expire within seven (7) days. The reminder is informational only — it is your responsibility to act on it before the expiry date if you wish to retain unused credits. Non-receipt of this reminder does not extend the expiry date or create any obligation on Creativehorns LLP.
- Renewal: Each new purchase or subscription renewal resets the 30-day validity window from the date of the new transaction. Recurring subscription renewals (Razorpay/PayPal auto-debit) extend the expiry by a fresh 30-day period from the successful renewal date.
- Free Trial Credits: New accounts receive 100 complimentary credits valid for 30 days from the date of account registration. These credits expire on the same terms as purchased credits.
- Pricing & Currency: All prices are listed in USD. Indian customers are billed in INR. Indian customers are billed in INR via Razorpay; international customers are billed in USD via PayPal. Applicable GST (Goods and Services Tax) is charged in accordance with Indian tax law for Indian residents. International transactions are treated as export of services and billed at the applicable rate.
- Invoicing: A tax invoice (GST-compliant where applicable) is generated for each successful payment. Invoices are issued by Creativehorns LLP, the legal entity operating PixelAPI. You are required to provide an accurate billing address at the time of purchase to ensure invoice compliance. Invoices may be updated if billing details are provided within 7 days of purchase.
- Refunds: Refunds are governed by our Refund Policy. Upon processing a refund, the corresponding invoice will be cancelled (voided), and the credits associated with that purchase will be deducted from your account balance. Any credits already consumed prior to the refund request cannot be refunded.
- Credits are non-transferable between accounts and have no cash value.
5. API Rate Limits
Rate limits apply per API key to ensure fair usage. Current limits are documented at pixelapi.dev/docs. We reserve the right to adjust limits to maintain service quality.
6. Intellectual Property
- Outputs generated by PixelAPI are owned by you, subject to applicable laws and the models' open-source licenses.
- PixelAPI's code, brand, and infrastructure remain the property of Creative Horns.
7. Service Availability
We target 99.5% uptime but do not guarantee uninterrupted service. Planned maintenance will be communicated in advance where possible. Credits consumed during confirmed outages will be refunded.
8. Limitation of Liability
To the maximum extent permitted by law, Creative Horns shall not be liable for indirect, incidental, or consequential damages arising from your use of PixelAPI. Our total liability shall not exceed the amount paid by you in the 30 days preceding the claim.
9. Termination
We reserve the right to suspend or terminate accounts that violate these Terms, without prior notice. You may cancel your account at any time per our Cancellation Policy.
10. Governing Law
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Hyderabad, Telangana, India.
11. Changes to Terms
We may update these Terms at any time. Continued use after changes constitutes acceptance. Major changes will be notified via email.
